§1. GENERAL PROVISIONS

1. GDPR INFORMATION FOR GUESTS Pursuant to Art. 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as "GDPR", I inform that:

The controller of your personal data, provided especially in connection with the made reservation and the execution of the short-term accommodation agreement, is the company Laguna Beskidów sp. z o.o. with its registered office in Zarzecze at Żeglarska 7, 34-326 Zarzecze, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court in Bielsko-Biała, 8th Commercial Division of the National Court Register under number KRS 0000920694, NIP: 5532573070, having REGON number: 389899170, share capital PLN 5,000.00 fully paid up (hereinafter: Controller). 3. Personal data will be processed by the Controller in accordance with generally applicable laws, including GDPR.
4. Personal data will be processed for the purpose of:
   1. concluding and performing contracts with tenants by the Controller (based on Art. 6(1)(b) GDPR) – for the duration of the agreement.
   2. fulfilling by the Controller the obligations resulting from generally applicable regulations, in particular civil, tax or accounting law (based on Art. 6(1)(c) GDPR) – for the period specified in those regulations (generally 5 years from the end of the year in which the event related to the collected data occurred).
   3. realizing the Controller’s legitimate interests (Art. 6(1)(f) GDPR), consisting of: i. conducting correspondence with tenants, including after the contract ends, ii. pursuing claims or defending against claims of tenants,

- for the duration of that interest, but not longer than 3 years after the cooperation ends.

4. Providing data is always voluntary, however, it is a condition for making a reservation and concluding the short-term accommodation agreement.

5. Data may also be processed by the Controller to a wider extent based on consent (Art. 6(1)(a) GDPR). In such a case, the data subject has the right to withdraw consent at any time – without affecting the lawfulness of processing based on consent before its withdrawal. Data will be processed for the period resulting from the content of the consent (or until the consent is withdrawn, whichever occurs first).

6. Your personal data may be disclosed to third parties only if permitted by law – other controllers or processors. Recipients may include especially: infrastructure administrators (including hosting providers), subcontractors, persons providing services related to contract execution, banks handling transfers for tenants, as well as advisors and auditors.

7. The Controller does not perform profiling of personal data nor transfers data to third countries (outside the European Economic Area). Your personal data will not be the basis for automated decision-making, including profiling by the Controller.

8. You have the right to request access to your personal data from the Controller, their rectification, deletion, or restriction of processing, as well as data portability;

9. Furthermore, you have the right to object to further data processing.

10. If processing is carried out unlawfully, you have the right to lodge a complaint with the supervisory authority – President of the Personal Data Protection Office (PUODO). PUODO contact details are available especially on the website https://uodo.gov.pl/pl/p/kontakt.

§4. COOKIES

1. Cookies are sent to web browsers and then stored in device memory and read by the server each time the Website is accessed.
2. We emphasize that the cookies storing does not allow us access to your private device or reading data other than those saved in cookies.
3. We use so-called technical cookies which enable proper use of message transmission, remembering your settings and creating simple website statistics.

Payment Terms and Conditions

1. General Provisions
1.1. These Terms and Conditions specify the rules for making payments using the online payment gateway of Laguna Beskidów Sp. z o.o. VAT ID: 5532573070

2. Accepted Payment Methods
2.1. Laguna Beskidów Sp. z o.o. accepts the following payment methods via online gateway:
Credit cards (Visa, MasterCard, American Express)
Online bank transfers
Other payment methods indicated on the company website.

3. Payment Conditions
3.1. The client is obliged to make payments by the deadlines indicated on the company website or in the agreement with Laguna Beskidów Sp. z o.o.
3.2. If payment is not made by the due date, the company has the right to cancel the reservation.

4. Refunds and Cancellations
4.1. Refunds made by clients are regulated based on the refund policy of Laguna Beskidów Sp. z o.o. available on the website.
4.2. The client has the right to cancel reservations; however, the cancellation deadlines and rules for charging cancellation fees are specified in the agreement or on the company’s website.
4.3. Free cancellation is possible up to 3 days before the reserved date only for reservations with a "refundable" price.
4.4. Reservations with a "non-refundable" price are non-cancellable.
4.5. Refunds are made within 7 days of cancellation.
4.6. For "refundable" reservations, a 30% deposit is due on the booking day. The remaining 70% is due 3 days before the reservation date. Failure to pay any deposit by the specified deadline results in automatic cancellation.
4.7. For "non-refundable" reservations, the full amount is due on the booking day. Failure to pay results in automatic cancellation.

5. Complaints
5.1. In case of services that do not comply with the agreement, guests should submit complaints in writing or by email within 14 days of the end of their stay using available contact forms: aparthotel@laguna-beskidow.pl or +48 694 299 224
5.2. Complaints should include the guest's details: name, surname, email address used during booking, and description of the issue.
5.3. The service provider will process the complaint within 14 days of its receipt and inform the guest in the same form: written or electronic.
5.4. If the complaint requires additional information, the service provider will request it within the complaint processing deadline. The 14-day deadline runs from the receipt of the completed complaint.
5.5. If the complaint is rejected, the service provider must provide a detailed explanation in writing or electronically.

6. Payment Security
6.1. Laguna Beskidów Sp. z o.o. ensures security of online transactions using appropriate technical measures to protect client data.
6.2. The client undertakes to keep payment details confidential and not disclose them to third parties.
